Terms and Conditions
1. This agreement between 14162854 INC (Photographer) and the client is for photographic services pertaining to residential or commercial real estate.
2. The Photographer grants [Client] a limited, exclusive, non-transferable right to
use the images created for the purpose of marketing the Property. [Client] understands that
Photographer owns the images and retains all rights, and may use them for
Photographer's own promotional purposes or re-sale. Client also warrants that 14162854 INC to have
the authority to enter into this contract for the Property, and shall indemnify and defend
the Photographer in the event of any litigation arising due to this contract.
3. The Photographer grants [Client] a limited, exclusive, non-transferable license for
the purpose of listing the Property under the [Client] current contract with the property
owner. This extends to [Client] use of images on the MLS listing as well as other
promotional materials intended to sell the property. These images may not be transferred
to any other party, including subsequent listing agents, the property owner for rental units or Contractors (ie, stagers, painters, etc) .
4. [Client] may not edit images or their client unless approved by the Photographer.
5.To ensure the best results of the photo shoot please be sure the property is ready
prior to the scheduled shoot time. It is the [Client] responsibility to ensure that the
listing is ready for the photo session to be produced at the arranged time.
5. For liability, Photographer does not handle any cleaning, dusting, or moving of
furniture. Photographer will, at his discretion move items like trash bins, throw rugs, towels,
bedspreads or any other small objects that may detract from the photograph. If we need to move items we will charge $50 plus depending on what is needed.
5. Payment is due at time of photo session. Billing will be sent before media is released. (Visa, MasterCard, etransfer to
[email protected] are accepted payment methods etc). Cancellation in less than 24 hours will result in a $50 fee.
6. Video edits are available but will cost $50 per edit. 1 Edit is included in our pricing.
